These Website Terms of Use (“Terms”) govern your access to and use of www.shiplab.com and any other public webpages or documentation sites operated by Shiplab Inc. that link to these Terms (collectively, the “Website”).
By accessing or using the Website, you agree to these Terms. If you do not agree, you should not use the Website.
1. About Shiplab
Shiplab Inc. (“Shiplab,” “we,” “us,” or “our”) provides data collection, processing, storage, access, and delivery services for carrier, logistics, warehouse, manifest, and related business data.
The Website provides information about Shiplab and its products and services.
2. Separate Agreements for Shiplab Services
These Terms govern use of the public Website. They do not independently govern access to or use of the Shiplab Management Portal, APIs, MCP server, AI connectors, data delivery features, paid subscriptions, trials, or other hosted services (collectively, the “Services”).
Use of the Services is governed by the applicable Shiplab Enterprise Services Agreement, an order or signup confirmation, or another written agreement between Shiplab and the applicable customer.
If these Terms conflict with an applicable services agreement, order, or other written agreement, that other agreement controls with respect to the Services.
3. Eligibility and Authority
The Website is intended for business and professional use. You must be at least 18 years old to use the Website.
If you use the Website on behalf of a company or other organization, you represent that you are authorized to act on its behalf.
4. Permitted Use
Subject to these Terms, Shiplab grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Website for lawful business purposes, including evaluating Shiplab’s Services and reviewing publicly available documentation.
You may download or print reasonable portions of publicly available Website content for your organization’s internal business use, provided you retain applicable copyright and proprietary notices.
5. Prohibited Conduct
You may not:
- Use the Website for an unlawful, fraudulent, or abusive purpose.
- Attempt to gain unauthorized access to the Website, the Services, customer accounts, systems, or networks.
- Interfere with or disrupt the security, integrity, availability, or operation of the Website.

Commercial terms displayed during signup, in an order, or in an applicable services agreement control over general information appearing elsewhere on the Website.

The Website may contain links to third-party websites, services, platforms, or resources. Shiplab does not control and is not responsible for third-party content, availability, security, or privacy practices.
Your use of a third-party service is governed by that third party’s terms and privacy policy. Providing a link or reference does not necessarily mean that Shiplab endorses or is affiliated with the third party.

Our Privacy Policy explains how Shiplab collects, uses, discloses, and protects information in connection with the Website and Services.
By using the Website, you acknowledge that information will be handled as described in the Privacy Policy.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
SHIPLAB DISCLAIMS ALL WARRANTIES REGARDING THE WEBSITE, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
SHIPLAB DOES NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE AVAILABLE, SECURE, ACCURATE, COMPLETE, OR ERROR-FREE.
These disclaimers apply to the public Website. Any warranties or service commitments applicable to the Services are governed by the applicable services agreement.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHIPLAB AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE WEBSITE.
SHIPLAB’S TOTAL LIABILITY ARISING FROM OR RELATED TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
These limitations do not apply where prohibited by law and do not replace or modify the liability provisions of an applicable services agreement.
12. Suspension or Termination of Access
Shiplab may restrict or terminate access to the Website if we reasonably believe a user has violated these Terms, created a security risk, interfered with Website operations, or acted unlawfully.
Provisions that by their nature should survive termination will remain effective, including provisions concerning intellectual property, disclaimers, limitations of liability, and governing law.
13. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
Any dispute arising solely from these Terms or use of the public Website will be brought in a court of competent jurisdiction located in North Carolina. Disputes concerning the Services are governed by the dispute provisions in the applicable services agreement.
14. Changes to These Terms
We may update these Terms periodically. When we do, we will update the Effective Date shown above.
Changes become effective when posted unless a later date is stated. Your continued use of the Website after the effective date of updated Terms constitutes acceptance of those changes.
Changes to an applicable services agreement are governed by that agreement and not by this section.
15. General Terms
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
Shiplab’s failure to enforce a provision is not a waiver of its right to do so later.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Shiplab concerning use of the public Website. They do not replace or modify any applicable services agreement, order, nondisclosure agreement, data processing agreement, or other written agreement between Shiplab and a customer or business partner.
